Booking Terms and Conditions

These Booking Terms and Conditions apply to training courses booked directly with Omega Performance Solutions Ltd. They explain how bookings, payments, cancellations, transfers and course changes are handled.

By making a booking, you agree to these terms. Nothing in these terms affects any statutory rights you may have as a consumer.

1. Course bookings and payment

Places on scheduled courses are subject to availability.

For individual bookings made online, payment is required in full at the time of booking. Your place is confirmed once payment is complete.

Employer bookings, purchase orders and invoice payments may be accepted by prior agreement. Unless otherwise agreed in writing, employer invoices must be paid in full before the course start date.

Prices shown to individual consumers include VAT where applicable. Business prices may also be shown exclusive of VAT, with the VAT-inclusive total stated where required.

2. What the course fee includes

The course fee includes the live instructor-led training and the learning materials stated on the relevant course page.

Where the course is delivered as PMI® certification exam preparation, the fee includes the applicable official PMI licensed learner materials provided as part of the course.

Unless expressly stated otherwise, certification examination fees, examination vouchers, PMI membership fees and certification application fees are not included in the course fee.

3. Consumer cancellation rights

If you are booking as an individual acting wholly or mainly outside your trade, business, craft or profession, you may have a legal right to cancel an online booking within 14 days of entering into the contract.

To exercise this right, you must clearly tell us that you wish to cancel.

If you ask us to begin providing the training or associated services during the 14-day cancellation period, you must make an express request for us to do so. If you then cancel before the service has been fully performed, you may be required to pay a proportionate amount for the services already provided.

If the service is fully performed during the cancellation period after your express request and acknowledgement that your right to cancel will be lost once performance is complete, your statutory cancellation right will end at that point.

Where digital course materials or learner access are supplied during the statutory cancellation period, separate consent or acknowledgement requirements may apply.

These statutory rights are separate from Omega’s cancellation and transfer policy below and are not restricted by it.

4. Omega cancellation and transfer policy

Where your statutory cancellation rights do not apply, or once any statutory cancellation period has ended, the following terms apply to cancellations and transfers requested by you.

More than 14 calendar days before the course start date

You may cancel your booking and receive a full refund, or transfer your booking once to another available course date.

Between 7 and 14 calendar days before the course start date

If you cancel, Omega may retain up to 50% of the course fee as a reasonable estimate of the direct net loss arising from the cancellation.

Alternatively, you may request one transfer to another available course date, subject to availability and any reasonable additional third-party costs.

Less than 7 calendar days before the course start date

If you cancel, Omega may retain up to 75% of the course fee as a reasonable estimate of the direct net loss arising from the cancellation.

Where reasonably practicable, Omega may instead allow one transfer to another available course date, subject to availability and any reasonable additional third-party costs.

How cancellation charges are calculated

Any amount retained will not exceed Omega’s actual net loss arising from the cancellation. In assessing that loss, Omega may take into account reasonable course administration, learner onboarding, non-refundable training materials or licences, trainer commitments and the loss of an opportunity to fill the place.

Omega will take reasonable steps to reduce its loss, including offering the place to another learner where reasonably practicable. Any costs saved or income received from a replacement booking will be taken into account.

These terms do not affect your statutory cancellation rights.

5. Substitutions and non-attendance

If you are unable to attend, you may nominate another suitable person to take your place at no additional charge, provided you notify us before the course begins.

Where PMI licensed learner materials or individual learner accounts have already been assigned, substitution may be subject to any applicable PMI licensing or administration requirements.

If you do not attend the course and have not cancelled, transferred or arranged an approved substitution, the course fee remains payable and no refund will be due.

6. Course changes or cancellation by Omega

We aim to deliver every course on the dates advertised. Occasionally, circumstances outside our reasonable control may require us to change the instructor, delivery arrangements or course date.

If Omega cancels a course, you may choose either a full refund of the course fee paid or a transfer to another available course date.

If we need to reschedule a course and the revised date is unsuitable, you may request a full refund.

Omega is not responsible for indirect costs incurred as a result of a course cancellation or rescheduling, such as travel, accommodation or loss of earnings, except where liability cannot legally be excluded.

7. Attendance, course completion and recordings

Learners are expected to attend and participate in the scheduled training sessions.

Where completion of a course requires a specified level of attendance, participation, knowledge check or other requirement, this will be explained during the course or onboarding process.

PMI licensed training sessions are not recorded. Learners must not record, reproduce or distribute course sessions or licensed course materials without permission.

Omega may retain appropriate attendance and completion records where required for administration, certification, compliance or quality assurance purposes.

8. Course materials and intellectual property

Course materials are provided for the registered learner’s personal use in connection with the course.

Materials supplied by PMI or other third-party rights holders remain subject to their respective intellectual property and licensing terms.

Course materials must not be copied, shared, reproduced, published, sold or distributed except where expressly permitted by the relevant rights holder.

9. Refunds

Where a refund is due, we will return it using the original payment method wherever reasonably possible.

Statutory refunds will be processed without undue delay and within the period required by law. Other approved refunds will normally be processed within 14 days.
